Samsung has decided to file a lawsuit against Apple Inc.(NASDAQ:AAPL)’s new smartphone, the iPhone5, terming it as an accused product, in the light of the amendment of its infringement contentions. The two companies are tangled in lawsuits over patent rights in about ten other countries, and both are unwilling to back down, due to the stiff competition in the market for smartphones.
Both the companies have been at the top of their game with the android phones, and both wish to sell the new products of their respective companies before the year-end. As they vie for the topmost position in the market, both Apple and Samsung have always had a very competitive outlook, and as such, have always been embroiled in lawsuits over key technologies.
Wishing to protect its property rights, and the new technologies, and despite having faced setbacks with regards to lawsuits in the past, Samsung has decided to not give up, by slapping on the new lawsuit over the Apple iPhone5, which has seen a phenomenal response with its bookings itself, by securing over 2 million bookings within 24 hours of the opening of the booking. The product is all set to hit the shelves by Friday.
Samsung had faced crushing defeat in a U.S lawsuit against Apple in August this year, when the jury had ruled in favour of Apple, and had awarded the company 1.05 million dollars, after declaring that the Korean company had stolen key features from the American one.
However, undeterred, Samsung wishes o fight back as aggressively and as intensely as possible, since this will also have a huge impact upon the sales of the smartphones of the two companies during the holiday season.
The U.S lawsuit for patent rights is a risky move for Samsung, considering the fact that they lost quite a few lawsuits against Apple in the past, but despite the setbacks, Samsung is convinced that their intellectual property must be guarded as fiercely as possible.
The setbacks during the lawsuits for Samsung, has also affected Google since its Android software stands to be the operating system for the Samsung smartphones.
